Nexbuild Privacy Policy

When you use the Services to generate takeoffs, we collect:

• Project descriptions and scope of work text
• Uploaded photographs, floor plans, and images
• Area measurements and dimensions
• Material selections and specifications
• Client information you input (names, addresses, project details)
• Feature selections and project configuration data

1.3 Payment and Billing Information

When you subscribe or purchase credits, we collect:

• Payment method details (processed and stored by our third-party payment processor; Nexbuild does not store full credit card numbers)
• Billing address
• Transaction history
• Subscription plan and credit balance

We automatically collect information about how you interact with the Services:

3.1 How AI Processing Works

The Services use third-party AI large language models ("LLMs") to process your User Data and generate takeoffs. When you submit project data, it is sent to third-party AI providers for processing.

3.2 Provider Flexibility

Nexbuild may use, change, or replace third-party AI providers at any time without notice. The Services are not tied to any specific AI provider, model, or version. Current and future providers may include, but are not limited to, various commercial AI services.

3.3 What Data is Processed

The following User Data may be sent to third-party AI providers for processing:

• Project descriptions and scope of work
• Uploaded photographs and images
• Area measurements and specifications
• Material selections
• Any other data you input into a project

3.4 AI Provider Data Handling

Third-party AI providers process your data in accordance with their own privacy policies and data handling agreements. Nexbuild selects AI providers that commit to not using customer data to train their general models. However, Nexbuild cannot guarantee the data handling practices of third-party providers.

3.5 Platform Improvement

Nexbuild may use anonymized and aggregated patterns from AI processing outputs to improve platform accuracy and develop new features. Individual project data is not sold, shared, or used for marketing purposes.

4.1 Service Providers

We share information with third-party service providers who perform services on our behalf, including:

• AI processing providers — to generate takeoffs and estimates
• Payment processors — to process subscriptions and credit purchases
• Cloud hosting providers — to store and serve the Services
• Analytics providers — to understand usage patterns (anonymized data only)
• SMS verification providers — to verify phone numbers for demo accounts (Twilio)

All service providers are contractually obligated to protect your information and use it only for the purposes for which it was shared.

4.2 Team Accounts

If you are part of a team account, other team members with appropriate roles may access shared project data within the team. Team owners and admins can view member activity and credit usage.

4.3 Legal Requirements

We may disclose your information if required to do so by law, regulation, legal process, or governmental request, or when we believe disclosure is necessary to: (a) comply with applicable law; (b) protect the rights, property, or safety of Nexbuild, our users, or others; (c) investigate potential violations of our Terms; or (d) detect, prevent, or address fraud or security issues.

4.4 Business Transfers

In the event of a merger, acquisition, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control.

5.1 Account Data

We retain your account information for as long as your account is active. If you delete your account, we will delete or anonymize your personal information within a commercially reasonable time, subject to legal retention requirements.

5.2 Project Data

Project data is retained for as long as your account or team account is active. Upon account termination or deletion, project data may be deleted in accordance with our data retention policy. Nexbuild is not responsible for data loss upon account termination.

5.3 Backup and Anonymized Data

Anonymized and aggregated data derived from your use of the Services may be retained indefinitely for platform improvement purposes. Backup copies may be retained for a reasonable period to ensure data integrity and disaster recovery.

5.4 Legal Obligations

We may retain certain information as required by law, regulation, or legal proceedings, or to enforce our Terms of Use.

6.1 Security Measures

Nexbuild implements industry-standard security measures to protect your information, including:

• Encryption of data in transit (TLS/SSL) and at rest
• Access controls limiting data access to authorized personnel
• Secure authentication mechanisms
• Regular security reviews and monitoring

6.2 No Absolute Guarantee

While we take reasonable measures to protect your information, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security of your data.

6.3 Your Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for restricting access to your devices. Notify us immediately at info@nexbuild.ai if you suspect unauthorized access to your account.

7.1 Access and Correction

You may access and update your account information at any time through your account settings.

7.2 Account Deletion

You may request deletion of your account and associated personal data by contacting us at info@nexbuild.ai or through your account settings. Please note:

• Deletion of team owner accounts is subject to the team succession rules in our Terms of Use.
• Certain information may be retained as required by law.
• Anonymized data may be retained for platform improvement.

7.3 Communication Preferences

You may opt out of non-essential communications by following the unsubscribe instructions in our emails. You cannot opt out of transactional or account-related communications.
